June 6, 2008 Update - General Update
 
Hi, everyone:
 
TGIF!  Please read the following updates and notices relative to your neighborhood:
 
1- Amending our Covenants and Bylaws:  As a reminder, we are still in need of your vote to pass the changes to the covenants and bylaws.  These changes are absolutely essential to ensuring maintained and increased property values of Avensong. 
 
2- Unauthorized persons at the pool and tennis courts:  As previously stated in e-correspondence and in a mailer to all homeowners, persons who are in the pool enclosure or inside the tennis court fence without an amenity card on their person will be considered trespassing and will be asked to leave.  This rule applies to everyone.  The police will be called if such persons refuse to leave.  There will be no exceptions.  If you rent out your home in Avensong and wish for your tenants to be able to use the amenities here, then you need to provide your amenity card to them.  It doesn't matter if you "live here" or that your "dues are paid."  You must have an amenity card with you.  This is to ensure that the amenities are only used by Avensong residents that are in good standing.  To that end, a homeowner without a card cannot be a "guest" of another homeowner who does.   Likewise, a renter without a card cannot be a "guest" of a homeowner or renter who does.  If your dues are paid, then you should have your own card.  Also the pool opens at 6:00 a.m. and closes at 10:30 p.m.  Anyone inside the pool enclosure after 10:30 p.m. will be considered trespassing and the police will be called.  If anyone sees people inside the pool after 10:30 or you see people jumping the fence or doing something they shouldn't be doing at any hour, please record the time and description of the individuals and e-mail this information to me so we can review the security tapes and work with the proper authorities to take action.  Also, please call 9-1-1.  Thanks for your cooperation in this matter.
 
3- Yards in the Carriage Section of the Neighborhood:  Yesterday, the board authorized for legal notices to be sent by our attorney to over 30 property owners in the Carriage due to failure to maintain their yards up to community standards.  The cost of each legal notice will be $90 + the cost of postage and will be billed to each respective violative homeowner's account.  The notice gives 10 days for the homeowner to bring the property up to community standards.  If the property owner fails to take action, the Association will hire a landscaper to abate the issue at a cost of $75 that will billed to the homeowner's account.  If these charges are not paid back to the Association within 30 days, collection activity may begin, liens, etc. and your amenity card will be deactivated.
 
4- Covenant Enforcement:  Relative to other issues such as:
 
  • rotten window and garage door frames
  • missing shutters
  • mold and mildew on your home or driveways
  • chipping paint
  • trash cans out on non-pick up days
  • not picking up newspapers from the yard, street, and driveways
  • failure to keep your back yard up to community standards
  • presence of A/C window units
  • parking on the grass or on the private streets off of Harmony Ct.
The management company has assured us that enforcement will be aggressive and consistent from this point forward.  I cannot stress enough the importance of taking action now to ensure that your property is up to community standards.  As you know, failure to remedy conditions once you receive a warning letter will result in $25 per day fines for each violation that you are cited for.  Many folks are consistently in violation of 3 - 4 things.  This could mean that you could be charged $100 per day for failing to keep your property up to standards!  You also should be aware that failure to keep your property up to standards could be in violation of city ordinances as well, and the city will cite you for failing to remove trash cans from the right of way or failing to maintain your yards. 
 
5- A/C Service:  Many of you followed my advice a few weeks ago to get your A/C condenser cleaned and freon re-charged.  Many of you also asked who I used.  I used Airmax, Inc.  (770) 788-3005.  The cost of the service was $79.95.  Well worth it!!!

May 24, 2008 Update - Additional Dates Announced to Pick Up Your Amenity Cards
 

Homeowners will have 2 additional opportunities to pick up amenity cards from the clubhouse.  These times will be Saturday, May 31 and Saturday, June 7 from 8:30 - 10:00 a.m.  If you have not picked up your amenity card by now and cannot pick up your card during one of these two additional times, then you will have to arrange to pick your card up from CommunityOne.  No exceptions.



April 28, 2008 Update - Next Garden Club Meeting Announced
 

Attention Avensong Gardeners:

On Saturday, May 10th, 
We will be meeting at the clubhouse at 11:00 a.m.
 
Please bring a plant to swap with other members.
 
We will also be judging for the "Best Yard" in Avensong.
 
Judging cards will be distributed at the meeting. We will
talley the card results and select a winner at this time. 
 
Light refreshments will be served.
 

All Avensong residents are invited to participate.

April 8, 2008 Update - April BOD Meeting Re-scheduled
 
The Board of Directors has decided to postpone our April meeting originally scheduled for tonight.  The meeting will now occur at 11:00 a.m. on Saturday, April 19 immediately after the informational session re: the proposed amendments to our Protective Covenants and Bylaws.  Thank you.


April 2, 2008 Update - Dates for a Community Garage Sale and Pool Opening Announced, Other News
 
1 - Community Garage Sale:  A decision has been made to have a community garage sale on Saturday, April 26, 2008.  The Association will cover costs for directional signs and advertising in the local newspapers.  We will also arrange for a charity to pick up anything that you don't sell and want to get rid of.  Hopefully, we can arrange to have this done late that Saturday.  I will send out more details on this later.
 
2 - Pool Opening Date and Party:  The pool will open on Saturday, May 24.  We will be having a pool party to kick off the pool season on the same day.  We will have a DJ, games, giveaways, and food and drink.  Please plan to attend to join in the fun!!!
 
3 - Amenity Cards:  In order to access the amenities this spring and summer, you must have a valid amenity card.  You must have your amenity card with you at all times when inside the gated areas (pool and tennis courts).  Only 1 card will be issued to each dues current ($0 account balance) homeowner.  Lessees need to contact their landlord to pick up the card for them.  The homeowner of record must present a picture id to pick up the card.  Amenity cards may be picked up at 1 of the 2 remaining information sessions for the proposed amendments to the Protective Covenants and Bylaws.   These meetings will be held at the clubhouse on Saturday, 4/19 and Saturday, 5/3 from 9:30 - 11:00 a.m.  
 
4 - Neighborhood Inspection:  Homeowners in the Carriage recently received a letter from the board discussing yard maintenance and the process that will be followed to ensure that the community is maintained to community standards.  A drive though the Carriage section yesterday evening indicated that there are still a large number of homeowners who are not heeding the contents of the letter, esp on Sonata Lane and Serenade Court.  The board cannot stress enough the importance of ensuring that your yard consistently meets the requirements specified in the letter.  Please be advised that an inspection will occur in the next several days.  As indicated in the letter, self help may (and will) be used to remedy poor conditions.   Homeowner accounts will be charged for the costs associated with this service (~$75.00 depending on what needs to be done).  In addition, your account must have a zero balance to obtain your amenity card or continue to enjoy access to the amenities.  Trash cans in view on non-trash pick up days, rotten window and door frames, and other issues will also be inspected during this time.  Believe it or not, we have homeowners that have incurred over $1,000 in fines (x number of days @ $25 a day) for not removing trash cans from sight on non-trash pick up days for months at a time.  As detailed in our enforcement policy, these homeowners will have to pay these fines or go to court.  This is the undesirable, costly, and unnecessary outcome for something as simple as not putting up your trash can in the evenings.

March 15, 2008 Update - Information Regarding Proposed Amendments to the Protective Covenants and Bylaws Posted
 

Two webpages, including a question and answer page, have been added to acquaint homeowners with the proposed amendments to the Protective Covenants and Bylaws.  In addition, the Avensong Board announces 3 informational meetings at the clubhouse to allow homeowners to learn more about about the proposed amendments.  The dates and times for these meetings are as follows:

  • March 25 from 7:30 - 9:00 p.m.
  • April 19 from 9:30 - 11:00 a.m.
  • May 3 from 9:30 - 11:00 a.m.


March 15, 2008 Update - New Village at Avensong Board Member
 

We are pleased to announce that Bonnie Fickle has been appointed to serve on the Village at Avensong Board as Secretary/Treasurer.  She will serve a 2 year term.  Per the Village at Avensong Bylaws, if there is no quorum present at the annual HOA meeting to elect officers, then the standing board members may appoint persons to fill any vacant positions.  Welcome, Bonnie!



March 9, 2008 Update - Proposed Changes to Our Protective Covenants and Bylaws in the Mail
   

Dear, homeowners:
 
If you haven't received it already, you should be receiving a packet in the mail very shortly that contains proposed amendments to our Protective Covenants and bylaws.  A consent form is also included.  
 
As a reminder, the presentations that were delivered during our 2/23/08 Annual HOA meeting have been posted on our website under the "HOA Meeting & Budget" webpage (http://www.avensong.org/Download.html).  Contained in one of these presentations is information about the proposed amendments.
 
The Board of Directors will be hosting several informational meetings at the clubhouse over the next few months.  During these meetings, we will present the proposed changes to you and detail why such changes are needed to protect our neighborhood.  You will have an opportunity to ask questions so that you clearly understand the changes on which you will be voting.  We will make sure that these meetings are scheduled at varied times and days so that you can arrange your schedule to attend at least one.  Our management company CommunityOne and our attorney John Lueder will be on hand during these meetings.  
 
Your key card for accessing the amenities will also be distributed during these meetings.  One key card will be issued to each dues current home.  For the safety and security of our neighborhood, the homeowner of record must present a picture identification to receive his or her key card. 
 
Information about when these meetings will be held, along with more specific information about the controlled access system and the distribution of amenity cards, will be forthcoming in the mail, e-mail, and on the website.  We expect to select the dates for these meetings this week and have something out to you shortly thereafter.

February 3, 2008 Update - Annual HOA Meeting Date Announced
 

Hi, everyone:

Our annual HOA meeting will be held on February 23 at 2:00 p.m. at Manning Oaks Elementary located at 405 Cumming Street, Alpharetta, GA 30004.  Please make plans to attend.

The official notice of this meeting, along with a proxy, will be sent to each homeowner's address of record.

The agenda will include, but will not be limited to, the following:

  • Election of one Avencroft rep to the Avensong master HOA board (must own a home and live in Avencroft)
  • Election of two reps to the Avencroft at Avensong board (must own a home and live in Avencroft)
  • Election of one rep to the Village at Avensong board (must own a home and live in the Village)
  • Report from our management company regarding our budget/financials and new reserve study
  • Report from the master Avensong board regarding accomplishments made since 3/07, future activities and initiatives, covenant enforcement, and proposed changes to our Protective Covenants and Bylaws
  • Reports from the Village and Avencroft Boards of Directors
  • Discussion of crime prevention

Council member Tina D'Aversa, Mayor Joe Lockwood, and Interim City Manager and Public Safety Director Chris Lagerbloom have all been invited to attend.

Nominations for board members may be submitted in advance to Devan Donald at ddonald@e-communityone.com.  Nominations will also be accepted during the meeting.

December 30, 2007 Update - Explanation of 2008 Dues
 

Hi, everyone:

Happy New Year to you and your families! The Avensong Board of Directors has received numerous questions regarding the 2008 annual assessments. A description of the changes follows.

As a reminder, there are three sections in Avensong: the Carriage, the Village, and Avencroft. All homeowners pay annual dues to the master association, (a.k.a. Avensong Community Association). Homeowners in the Village and Avencroft pay additional dues to your respective "sub-neighborhood" boards to pay for landscaping and feeder street maintenance (in the case of Avencroft only), as well as related management and attorney fees. Lawn maintenance in the Carriage is the responsibility of the individual homeowners.

With that in mind, if you own a home in the Village or Avencroft, you should have recently received 2 invoices. Homeowners in the Carriage should have received on one invoice.

Invoices for the Village and Avencroft association dues should reflect an overall annual reduction of $30. In contract, the invoice for the master association dues, which everyone should have received, should reflect an overall annual increase of $30. This essential means that homeowners in the Village and Avencroft have a zero net change in their total 2008 dues, whereas homeowners in the Carriage will have a net increase of $30.

A recent reserve study conducted by an engineering firm hired by the Avensong BOD revealed that an increase in the master association dues was necessary to keep pace with inflation and build our reserve funds to ensure long term maintenance of our neighborhood. The results of the reserve study will be explained in detail during our annual HOA meeting tentatively scheduled for 2/2/08.

To lessen the impact of this $30 net increase to Carriage homeowners and as a courtesy to everyone in light of the financial stresses often brought about by the holidays, the Avensong BOD made a decision to divide the $330 master association dues into 2 equal payments of $165. Despite this, you are welcome to pay the entire $330 in January.

The Avensong, Village at Avensong, and Avencroft at Avensong Boards of Directors have instructed the management company to hold off on charging any late fees until 2/1/08 (you will notice an earlier date in the billing invoices). Payments received on or after 2/1/08 will receive a late fee and will incur interest charges. Collection activity will be aggressive.

December 19, 2007 Update - Recent Work by AT&T
 

Relative to the recent work in Avensong by AT&T, as you probably already know, AT&T recently upgraded its network in our neighborhood. Their recent work allows them to provide better services to us, like faster high speed internet, clearer calls, etc.

It was brought the the Board of Director's attention that a water line break occurred in the Village during the digging. If you live in the Village and notice a spike in your water bill, you may wish to file a claim with AT&T by calling 1-800-894-0374.

AT&T was called to voice the board's displeasure about the flags that they left behind and the condition of some of the utility boxes. They seem to have done a pretty good job with replacing the grass.

In response, they are supposed to be checking the utility boxes in the yards to ensure that they are in good repair. If you have a utility box in your yard that is in disrepair, specifically the phone utility box, please call 770-429-7924.
